Terms of Service – WaveHouse Apparel

Welcome to WaveHouse Apparel, operated by CMCS Group Inc. ("WaveHouse", "we", "us"). By using our website or services, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By placing an order, submitting artwork or personalization, or using our services, you agree to be bound by these terms. If you do not agree, please do not use our services.

2. Services Provided

  • WaveHouse Apparel provides custom and branded apparel, embroidery, DTF printing, headwear, promotional products, design support and WaveHouse Mall online stores.
  • We may decline any order we consider inappropriate, offensive or in violation of copyright or trademark laws.
  • Orders are produced from the specifications, artwork and personalization you provide. You are responsible for making sure all details, including spelling, numbers and sizes, are correct before submitting.

3. Orders and Payment

  • Orders must be paid in full before production begins, unless otherwise agreed in writing.
  • We accept credit and debit cards, PayPal and Shop Pay through our online checkout, as well as Interac e-Transfer, cash and cheque for quoted and in-person orders.
  • Card processing fees may be added to card payments on quoted orders.
  • If a design needs significant changes or custom artwork, additional charges may apply. We'll let you know and get your approval before proceeding.

4. Production Timeline

  • Production time depends on the size and complexity of the order. Estimated timelines are provided at checkout or with your quote.
  • Rush orders may include additional fees and must be confirmed in writing.
  • We are not responsible for delays outside our control, including supply chain disruptions or carrier delays.

5. Shipping and Pickup

  • Orders can be shipped to your address or picked up at our Cap-Pelé location.
  • Shipping costs are the customer's responsibility unless otherwise stated.

6. Returns and Replacements

  • Because every order is made to order, we do not offer refunds. If your order arrives with a defect, an incorrect product or a decoration error caused by us, we will replace the affected item(s) at no additional cost.
  • Replacement requests must be made within 7 days of receiving your order, with photos of the issue.

7. Photos of Customer Orders

Unless you ask us not to, we may photograph and showcase apparel we produce on social media, our website and in marketing materials. To opt out, let us know in writing when you place your order.

8. Intellectual Property

  • You confirm that you hold the necessary rights to any designs, logos or images you submit.
  • WaveHouse Apparel is not liable for unauthorized use of copyrighted or trademarked material supplied by customers.
  • WaveHouse designs, product designs, logos and website content remain the property of WaveHouse Apparel.

9. Limitation of Liability

  • We are not liable for indirect, incidental or consequential damages resulting from the use of our products or services.
  • Our liability is limited to the amount paid for the order in question.

10. Governing Law

These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there.

11. Changes to These Terms

We may update these terms at any time. The latest version will always be posted on this page with the date of the last update.
